• Provide accurate, complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

4. Subscription and Payment

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless otherwise stated
• We may change pricing with 30 days' notice
• You are responsible for all applicable taxes
• Failure to pay may result in service suspension

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Violate any local, state, or international laws
• Transmit malicious code or interfere with the Service
• Attempt to gain unauthorized access to our systems
• Use the Service to send spam or unsolicited communications

6. AI Voice Services

Regarding our AI voice capabilities:

• AI responses are generated automatically and may not always be accurate
• You are responsible for reviewing and verifying AI-generated content
• Call recordings are stored securely and used to improve service quality
• You must comply with applicable call recording and consent laws
• AI is designed to assist, not replace, professional judgment

7. Intellectual Property

The Service and its original content, features, and functionality are owned by TradesAgent.ai and are protected by copyright, trademark, and other intellectual property laws. Your business data remains your property; you grant us a license to use it solely to provide the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring your use of our Service complies with applicable data protection laws, including obtaining necessary consents from your customers.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRADESAGENT.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE PAST 12 MONTHS.

11. Indemnification

You agree to defend, indemnify, and hold harmless TradesAgent.ai and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or us. You may terminate your account at any time. Upon termination, your right to use the Service will cease immediately.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Austin, Texas.
